Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the AI Shopping Feeds service.

1. Definitions

For the purposes of these Terms:

  • “Service” refers to the AI Shopping Feeds website at www.aishoppingfeeds.com and the application at app.aishoppingfeeds.com, including all features, tools, APIs, and content provided through them.
  • “Company” (referred to as “we”, “us”, or “our”) refers to AI Shopping Feeds.
  • “You” (referred to as “you” or “your”) means the individual or legal entity accessing or using the Service.
  • “Account” means a registered user account on the Service.
  • “Product Feed Data” means product catalog information, feed configurations, and related business data you upload to or create within the Service.
  • “Subscription” means a paid plan providing access to premium features of the Service.

2. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

You represent that you are at least 18 years of age and have the legal authority to enter into these Terms. If you are using the Service on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.

3. Account Registration

To use the Service, you must create an account by providing your name, email address, and a password. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorised access to your account
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. The Service

4.1 Description

AI Shopping Feeds is an AI-powered product feed management and optimisation platform. The Service enables you to:

  • Upload, manage, and optimise product feed data
  • Apply AI-powered enhancements to product titles, descriptions, and attributes
  • Generate and export feeds to advertising and commerce channels (Google Ads, Microsoft Advertising, Meta Catalogs, TikTok Shop, and 200+ other platforms)
  • Access feed analytics and performance recommendations
  • Connect via API and MCP integrations

4.2 AI-Generated Content

The Service uses artificial intelligence to optimise and enhance your product feed data. You acknowledge that:

  • AI-generated optimisations are suggestions and should be reviewed before use
  • We do not guarantee that AI-generated content will be error-free, accurate, or suitable for any particular purpose
  • You are responsible for reviewing and approving all AI-generated modifications to your product data before they are exported to any channel
  • AI outputs may occasionally produce unexpected or incorrect results
  • You remain solely responsible for the content of your product feeds as published on any third-party platform

4.3 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance, and the Service may experience downtime due to circumstances beyond our control.

5. Subscriptions and Payments

5.1 Plans and Pricing

The Service offers free and paid subscription plans. Current pricing is available at www.aishoppingfeeds.com/pricing. We reserve the right to change pricing with 30 days’ notice.

5.2 Billing

Paid subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your plan). Payments are processed securely by Stripe. By subscribing to a paid plan, you agree to Stripe’s Terms of Service.

5.3 Free Plan

The Service includes a free plan. You may use the free plan without a time-limited trial period. If you upgrade to a paid plan, billing begins only after the upgrade is confirmed.

5.4 Cancellation

You may cancel your subscription at any time through the application. Upon cancellation:

  • You will retain access to paid features until the end of your current billing period
  • No further charges will be made
  • Your data will be retained for 30 days after account deletion (see Section 8)

5.5 Refunds

The Service is a digital commercial service that utilises AI processing, including third-party large language model APIs, which incur costs upon usage. Because these costs are consumed in real time and cannot be recovered, all subscription fees and usage charges are non-refundable once the Service has been accessed or AI processing has been performed during a billing period.

If you are a consumer in the UK or EEA, you acknowledge that by using the Service (including any AI-powered features), you consent to the immediate performance of the Service and you acknowledge that you lose your right of withdrawal under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (or equivalent EEA legislation) once the Service has been fully performed or AI processing has commenced.

If you believe you have been charged in error, please contact us at support@aishoppingfeeds.com and we will review your request.

6. Your Data and Intellectual Property

6.1 Your Data

You retain all ownership rights to your Product Feed Data and any content you upload to the Service. By using the Service, you grant us a limited, non-exclusive licence to access, process, optimise, and export your data solely for the purpose of providing the Service to you.

6.2 Our Intellectual Property

The Service, including its design, features, code, documentation, and branding, is owned by AI Shopping Feeds and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

6.3 Feedback

If you provide us with feedback, suggestions, or ideas, you grant us a non-exclusive, royalty-free, worldwide licence to use and incorporate that feedback into the Service without obligation to you.

6.4 Logo and Brand Usage

By creating an Account, you grant AI Shopping Feeds a non-exclusive, royalty-free, worldwide licence to use your company name and logo solely for the purpose of identifying you as a customer of the Service in our marketing materials, website, presentations, and promotional content. You may revoke this licence at any time by emailing support@aishoppingfeeds.com, and we will remove your branding within 30 days of receiving your request.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload content that infringes the intellectual property rights of others
  • Attempt to gain unauthorised access to the Service or its infrastructure
  • Use automated tools (other than our provided APIs) to scrape or extract data from the Service
  • Interfere with or disrupt the Service or its servers
  • Resell or redistribute the Service without our written consent
  • Upload malicious code, viruses, or harmful content
  • Use the Service to send spam or unsolicited communications

We reserve the right to suspend or terminate your account for violation of these terms.

8. Account Deletion and Data Handling

8.1 Account Deletion

You may delete your account at any time through the application at app.aishoppingfeeds.com. You may also request account deletion by emailing support@aishoppingfeeds.com.

8.2 Data Deletion

Upon account deletion:

  • All personal data and Product Feed Data will be permanently deleted within 30 days
  • Backup copies will be removed within 90 days
  • Payment records may be retained as required by applicable tax and accounting laws
  • Anonymised, aggregated data that cannot identify you may be retained

8.3 Data Portability

You may request a copy of your data at any time by contacting support@aishoppingfeeds.com. We will provide your data in a structured, commonly used, machine-readable format within 30 days.

9. Third-Party Services

9.1 Integrations

The Service integrates with third-party platforms for feed export, payments, and other functionality. Your use of these integrations is subject to the respective third party’s terms and privacy policies.

Our Service may contain links to third-party websites or services. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites.

10. Limitation of Liability

10.1 Non-Excludable Liability

Nothing in these Terms excludes or limits our liability for:

  • (a) death or personal injury caused by our negligence;
  • (b) fraud or fraudulent misrepresentation;
  • (c) any breach of the obligations implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982;
  • (d) any liability which cannot be excluded or limited under applicable law, including under the Consumer Rights Act 2015 where applicable; or
  • (e) any liability arising from our obligations as a data processor under UK GDPR and the Data Protection Act 2018.

10.2 Exclusion of Indirect and Consequential Losses

Subject to clause 10.1, we shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, misrepresentation, restitution, or otherwise, for any:

  • (a) loss of profits, revenue, or anticipated savings;
  • (b) loss of business or business opportunity;
  • (c) loss of goodwill or reputation;
  • (d) loss of data (except to the extent caused by our breach of our data protection obligations);
  • (e) indirect, special, incidental, consequential, or punitive damages; or
  • (f) any loss or damage arising from your reliance on AI-generated content, optimisations, or recommendations produced by the Service, or from the publication, export, or use of any data processed through the Service on any third-party platform,

in each case whether or not such loss or damage was foreseeable and even if we had been advised of the possibility of such loss or damage.

10.3 Liability Cap

Subject to clause 10.1, our total aggregate liability to you in respect of all claims arising out of or in connection with these Terms and your use of the Service, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no event exceed the greater of:

  • (a) the total fees paid by you to AI Shopping Feeds during the twelve (12) month period immediately preceding the event giving rise to the claim; or
  • (b) one hundred pounds sterling (£100).

10.4 Your Responsibility

You acknowledge and agree that:

  • (a) the Service provides AI-generated content, product feed optimisations, and recommendations as tools to assist your decision-making, and not as a substitute for your own independent judgement;
  • (b) you are solely responsible for reviewing, verifying, approving, and publishing any content — including AI-generated modifications — before it is exported, published, or submitted to any third-party platform;
  • (c) the decision to use, export, publish, or rely on any data processed by the Service is entirely yours, and you accept full responsibility for the consequences of such decisions;
  • (d) we do not guarantee any particular outcome, improvement, or performance result from the use of AI-generated optimisations on any third-party advertising or shopping platform; and
  • (e) you are responsible for ensuring that any content published through the Service complies with the policies, guidelines, and terms of the third-party platforms to which it is exported.

10.5 Severability of Limitations

Each sub-clause of this Section 10 is a separate and independent limitation on liability. If any sub-clause is held to be unenforceable, the remaining sub-clauses shall continue in full force and effect.

11. Disclaimer of Warranties

11.1

Subject to clause 10.1, and except as expressly set out in these Terms, the Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties or conditions of any kind, whether express, implied, or statutory.

11.2

To the maximum extent permitted by applicable law (and without limiting clause 10.1), we specifically disclaim all implied conditions, warranties, representations, and other terms that may apply to the Service, including but not limited to:

  • Implied warranties of satisfactory quality, fitness for a particular purpose, and non-infringement;
  • Any warranty that the Service will be uninterrupted, timely, error-free, or secure;
  • Any warranty regarding the accuracy, reliability, completeness, or suitability of AI-generated content, optimisations, or recommendations;
  • Any warranty that the Service will meet your specific requirements or produce any particular result.

11.3

Nothing in this Section 11 is intended to exclude or restrict any rights that you may have as a consumer under the Consumer Rights Act 2015, which cannot be excluded or restricted by contract.

12. Indemnification

You agree to indemnify and hold harmless AI Shopping Feeds and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you upload to the Service

13. Termination

13.1 By You

You may stop using the Service and delete your account at any time.

13.2 By Us

We may suspend or terminate your access to the Service immediately, without prior notice, if:

  • You breach these Terms
  • Your use poses a security risk to the Service or other users
  • We are required to do so by law
  • We discontinue the Service (with reasonable notice)

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive (including Limitation of Liability, Disclaimer of Warranties, Indemnification, and Governing Law).

14. For European Economic Area (EEA) and UK Users

If you are located in the EEA or the United Kingdom:

  • Nothing in these Terms is intended to exclude or limit any mandatory rights you have under the consumer protection laws of your country of residence, including the Consumer Rights Act 2015 (for UK users) or equivalent EEA legislation. Where any provision of these Terms conflicts with such mandatory rights, those mandatory rights shall prevail.
  • Nothing in these Terms affects your rights under the UK GDPR, EU GDPR, or the Data Protection Act 2018, including your rights to access, rectify, erase, restrict, and port your personal data as described in our Privacy Policy.
  • You may exercise your right to data deletion at any time (see our Privacy Policy, Section 9).
  • You have the right to lodge a complaint with your local data protection authority.

15. Governing Law and Disputes

15.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law provisions. If you are a consumer in the EEA or UK, you will also benefit from the mandatory provisions of your local consumer protection laws.

15.2 Dispute Resolution

If you have a dispute about the Service, please contact us at support@aishoppingfeeds.com and we will work with you to resolve it as quickly as possible.

16. General Provisions

16.1 Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

16.2 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

16.3 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AI Shopping Feeds regarding your use of the Service.

16.4 Assignment

We may assign or transfer these Terms without restriction. You may not assign your rights or obligations under these Terms without our prior written consent.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days’ notice by:

  • Posting the updated Terms on this page
  • Updating the “Last updated” date
  • Sending an email notification where appropriate

Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms. If you do not agree to the new Terms, please stop using the Service.
